Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased toIssue a writ, order or direction, more particularly one in the nature of Writ of Mandamus, declaring the action of the 3rd respondent in accepting and awarding the open National Competitive Bidding electrical works contract of Sri Durga Malleswara Swamy Varla Devasthanam, Vijayawada, in favour of the 4th respondent proprietary concern, whose proprietor Sri Shaik Nayum, son of Ibrahim, does not profess Hinduism, as illegal, arbitrary, unconstitutional, contrary to the scheme of the Andhra Pradesh Charitable and Hindu Religious Institutions and Endowments Act, 1987 (Act 30 of 1987), contrary to G.O.Ms.No.426, Revenue (Endowments-I) Department, dated 09.11.2015, contrary to the binding ratio of the common judgment of this Hon'ble Court in W.P.No.40252 of 2015 and batch, dated 27.09.2019, and contrary to Articles 14, 25 and 26 of the Constitution of India, and consequently direct the respondents 1 to 3 to disqualify the 4th respondent and to accept the petitioner's bid, being the next lowest eligible Hindu Class-I Electrical Contractor, and award the work to the petitioner.
