ORDER :

This writ petition under Article 226 of the Constitution of India is filed seeking the following relief:-

“…to issue a writ, order or direction, more particularly one in the nature of writ of Mandamus or any other appropriate writ or direction declaring the action of the respondents in not releasing the total pass order amount of Rs.11,13,369/- of agreement, dated 03.10.2023, vide M. Book No.3995-A for construction of culvert and approach road from Yerukali Sunkanna (H) to New GS & RBK building in Mettupalli (V), Peapully mandal in Nandyal district under G.G.M.P. Grant funds, as illegal, arbitrary and violative of Articles 14 and 21 of the Constitution of India and consequently direct the respondent authorities to release the pending bills of Rs.11,13,369/- forthwith.”

The case of the petitioner, briefly stated, is as follows:-

The petitioner is a permanent resident of Peapully, Nandyal district and is doing various contractual works, such as, supply of unskilled labour and construction material under G.G.M.P., O & M, & P.R.I. funds to various authorities. He supplied construction material for the construction of culvert and approach road from Yerukali Sunkanna (H) to New GS & RBK Building in Mettupalli (v) of Peapully mandal, Nandyal district. Accordingly, the petitioner entered into the agreement, dated 03.10.2023, with Panchayat Raj, Engineering department. He commenced the work on 03.10.2023 and completed execution of the work. completed on 16.12.2023. However, the respondents have not released amount for the works executed by the petitioner.

The learned Assistant Government Pleader for Panchayat Raj & Rural Development placed on record a copy of the written instructions vide Lr. Rc. No.SA4 / W.P.No.24862 of 2026, dated 08.09.2026, wherein it was stated as follows:-

“There is no budget allocated regarding G.G.M.P. Soon after receiving the budget, the bill will be uploaded in NIDHI portal and it will be presented to PAO, Kurnool. An amount of Rs.11,08,786/- has to be paid to the petitioner. When funds are released to the petitioner, net amount of Rs.10,15,229/- will be released to the petitioner after deducting the statutory recoveries of Rs.93,257/-.”

The learned counsel for both the parties requested to dispose of the writ petition in the light of the written instructions.

Having regard to the above submissions, the writ petition is disposed of directing the respondents to release the admitted amount of Rs.10,15,229/- (Ten Lakh Fifteen thousand two hundred and twenty nine only) to the petitioner, along with interest as per the entitlement, within a period of two (2) months from the date of receipt of a copy of this order. There shall be no order as to costs.

Pending miscellaneous petitions, if any, shall stand closed.
