Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to Issue a writ of mandamus or any other appropriate writ, order or direction, declaring the action of the respondents in not releasing the approved bill an amount of Rs.4,04,297/-(Rs.Four lakhs four thousand two hundred ninty seven rupees ) for the completed cyclone damage repair works at Z P High School at Narsipuram village of Nandigam Mandal in Srikakulam District as illegal, arbitrary, and unconstitutional, and consequently direct the respondents to immediately release the said amount with interest, within a time frame fixed by this Hon’ble Court, and pass such other orders.

The present Writ Petition is filed questioning the action of Respondents in not releasing the admitted amounts of Rs.4,04,297/- for completing cyclone damage repair works at Z.P. High School at Narsipuram Village, Nandigama Mandal, Srikakulam District, as illegal and arbitrary.

Sri V.C.H. Naidu, learned Standing Counsel appearing for Respondent Nos.4 and 5 passed on signed instructions of Respondent No.4, wherein it is stated that the amount payable to the Petitioner is Rs.4,66,538/- and the bill is ready to be generated in the NIDHI portal, but was not generated due to insufficient budget.

Considering the fact that the work done by the Petitioner and the amounts due were admitted, the Writ Petition is disposed of, with the following directions;

(i) The Respondent-authorities are directed to pay admitted amount of Rs.4,66,538/- to the Petitioner, as expeditiously as possible, preferably within a period of four (04) months from the date of receipt of a copy of this order;
