The Court made the following order:

Heard learned counsel for the petitioner, the learned Government Pleader for Municipal Administration and Urban Development Department, learned Standing Counsel for the respondent Nos.4 to 6 and the learned Assistant Government Pleader for Finance and Planning.

The grievance of the petitioner in the instant writ petition is against the action of the respondents in not releasing the amounts for the works executed by the petitioner i.e., (i) Supply, Delivery and Fixing of Electric Items of 400 Sq Wire, Aluminum and Copper Lugs, Electric Impact Wrench and 100 HP Pump Repair and Recondition WPIL Make Pump Works at 18 MLD SS Tank, Kothuru, Nellore Municipal Corporation (ii) Engaging of JCB, Special Labour, Tractor and tree cutting machines for jungle clearing in NTR Housing layouts of Akkacheruvupadu 43.35 Acres, Akkacheruvupadu 32 Acres, Akkacheruvupadu 8 Acres, Akkacheruvupadu 61 Acres and Ambhapuram Layouts in Division No.31 of Nellore Municipal Corporation (iii) Laying of Wet Mix Patches at NTR Housing Layouts of Akkacheruvupadu 43 Acres layouts in Division No.31 of Nellore Municipal Corporation and (iv) Laying of BT Patches at Kallurupalli Main Road and Buja Buja Nellore in Division No.23 and 25 of Nellore Municipal Corporation.

It is submitted that the petitioner had completed the works entrusted to him and that the competent authority of the respondents had also approved the payments due and payable to the petitioner. The respondents have also recorded the progress of the work and the amounts due and payable to the petitioner in the M-Book.

During the course of hearing, the learned Standing Counsel appearing for respondent Nos.4 to 6, on instructions, submits that the bills have been approved for clearance and that the Government has also released funds for clearing the outstanding bills of the contractors. It is further submitted that additional funds are required to clear and the same is awaited and, upon release of the same, the amounts due and payable to the petitioner shall be cleared.

Recording the submissions, this writ petition is disposed of directing the concerned respondent to verify the claim of the petitioner and release the payments due and payable to the petitioner as expeditiously as possible, preferably within a period of two months from the date of receipt of a copy of this order. There shall be no order as to costs.

As a sequel, all pending miscellaneous applications, if any, shall stand closed.
