ORDER :

This writ petition is filed under Article 226 of the Constitution of India, to declare the action of the respondents in not releasing the bill amount worth of Rs. 2,96,761/- (rupees two lakh ninety six thousand seven hundred and sixty one only) with interest @ 24% vide the agreement bearing No. /2022-23, dated 08.11.2022, of the 4^th respondent with work ID No. 5183-18214 and M. Book No. 1117/A/2019-20 under the grant GGMP to the petitioner till today even after completion of construction of pipe culvert near the old Harijanawada in Piduru Grama Panchayat of Manubolu mandal within time and causing heavy loss, as illegal and consequently direct the respondents to release the above amount.

The learned Assistant Government Pleader for Panchayat Raj and Rural Development, representing the respondent No. 4, placed on record a copy of the written instructions of the Executive Engineer, PRI Division, Nellore, dated 02.09.2026 admitting that the petitioner is entitled to receive Rs. 2,96,368/-, but the payment could not be made as the budget is not available under GGMP grant for DDO Code 08012202163 of the Executive Engineer, PRI Division, Nellore.

The petitioner sought Rs. 2,96,761/-, whereas the respondents admitted the liability of Rs. 2,96,368/-. In the light of the written instructions admitting partial liability, the learned counsel for the petitioner requested to dispose of the writ petition directing the respondents to pay the admitted amount.

Having regard to the submissions made on both the sides, the writ petition is disposed of, directing the respondents to release the amount of Rs. 2,96,368/- (rupees two lakh ninety six thousand three hundred and sixty eight only) to the petitioner, along with the interest, if any, as per the lawful entitlement, within a period of three (02) months from the date of receipt of a copy of this order.

There shall be no order as to costs.

Pending miscellaneous petitions, if any, shall stand closed.
