The Court made the following ORDER:

This Writ Petition has been filed seeking to declare the inaction of the respondents in paying a sum of Rs.9,60,000/towards the supply of water works entrusted by the respondent Nos.6 and 7 in favour of petitioner, for supply of water to Dr.B.R.Ambedkar Gurukulam (APSWRS/JC) Junior College, Ramapuram, Ramapuram Mandal, Annamayya District, for the period of 48 months i.e., from April, 2020 to April, 2024, even after submission of bills and requests made by petitioner for release of the said sum through her letters and even after lapse of 16 months from the period of completion of the said work, as illegal and arbitrary and consequently direct the respondents to pay the said amount due to the petitioner in respect of execution of aforementioned work forthwith.

Case of the petitioner is that, she is a registered water supply contractor and used to supply water through borewells for certain amount on agreement basis. Respondent No.3 accorded permission to respondent Nos.5 to 7 to purchase water from the petitioner’s borewell at the cost of Rs.20,000/- per month to respondent No.7 campus. In turn, respondent No.7 approached the petitioner for water supply to 7^th respondent campus at the cost of Rs.20,000/- per month and entered into agreement dated 01.08.2019 and thereby extending the agreements from time to time. Petitioner executed the work in accordance with the terms and conditions of the agreement without any deviation, whereas, the respondents failed to pay the amount for supplying the water. It is the duty of the respondents to pay the amount for the work done by the petitioner.

Today, when the matter came up for admission, learned Assistant Government Pleader for Finance and Planning submits that respondents agreed to pay an amount of Rs.9,00,000/- to the petitioner for the work done by her. Learned counsel for petitioner accepted for the same.

Recording the said submission and in view of the aforesaid facts and circumstances and as there is no dispute with regard to the execution of work and the amount due to the petitioner, the respondents are directed to release the amount of Rs.9,00,000/(Rupees nine lakhs only) to the petitioner within a period of eight (8) weeks from the date of receipt of a copy of this order, failing which, the Writ Petitioner is entitled to claim interest @ 6% per annum from the date of this order till the date of realization.
