ORDER :

The Writ Petition has been filed under Article 226 of the Constitution of India seeking the following relief:-

“…to issue a writ order or direction more particularly one in nature of Writ of to issue a writ order or direction more particularly one in the nature of writ of Mandamus declaring the action of the 3rd Respondent in not properly conducting investigation and filing final report/charge sheet in FIR No 181/2025 for the offences punishable under Sections 3162 3184 3363 351 2 r/w 35 BNS even after the lapse of 260 days as illegal arbitrary violative of Sections 187 r/w 193 BNSS 2023 and contrary to standing orders stipulated under The A P Police Manual….”

2. Heard the learned counsel for the petitioner and the learned

Assistant Government Pleader.

Mr.Arrabolu Sai Naveen, the learned counsel for the petitioner, submits that although the complaint lodged by the petitioner was registered as a case against Accused in F.I.R.No.181 of 2025, dated 06.05.2025 on the file of Sarpavaram Police Station, Kakinada District, for the alleged offences punishable under Sections 316(2), 318(4), 336(3), 351(2) read with 3(5) of the Bharatiya Nyaya Sanhita, 2023 (for brevity ‘the BNSS’), by Respondent No.3, he has failed to proceed with the investigation and has not taken any steps to file the charge sheet.

Sri P. Ajay Babu, learned Assistant Government Pleader, on instructions, submits that the investigation has been completed and the charge sheet was filed on 02.08.2025 before the learned Special Mobile Judicial First Class Magistrate, Kakinada.

In view of the above submissions of the learned Assistant Government

Pleader, the Writ Petition is disposed of granting liberty to the petitioner to avail appropriate remedies before the learned jurisdictional Magistrate concerned by filing appropriate petitions, if aggrieved by the investigation findings, in accordance with law, pursuant to the filing of the charge sheet.

In the result, the Writ Petition is disposed of. There shall be no order as to costs.

As a sequel, Miscellaneous petitions, if any pending, shall stand closed.
