Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased toissue Writ order or direction more particularly on in the nature of Writ of Mandamus declaring the action of the respondents in not releasing the admitted contract bill net amount of Rs.22,00,421/- (twenty two lakhs fourhundred and twenty one rupees only) for the work executed by the petitioner under the work Maintenance and repairs to Social Welfare Girls hostel at Pamulapadu (V M) in Nandyala District through the agreement No.EE/ /2024-25 dt.28.01.2025,and with 6 interest is illegal, arbitrary and contrary to law and un constitution and in violation of Article 14 of the Constitution of India and consequently direct the respondent authorities to release the admitted bill of net amount of Rs.22,00,421/- with 6 interest per annum to the petitioner in respect of the execution of aforementioned works forthwith

ORDER:

The petitioner is aggrieved by the action of the respondents in not releasing the admitted contract bill net amount of Rs.22,00,421/- (Rupees Twenty Two Lakhs Four Hundred Twenty One only) for the work executed by the petitioner under the work Maintenance and repairs to Social Welfare Girls hostel at Pamulapadu (V & M) in Nandyala District, through the Agreement No.EE/ /2024-25, dated 28.01.2025.

The learned counsel further submits that the petitioner duly executed all the works and thereafter submitted final bills, which were duly endorsed by the competent authority. A statement detailing the works executed by the petitioner was prepared, and the progress of the work was recorded in the M- book. However, in spite of the completion of all procedural formalities, the payment towards the completed works has not been released till date.

Heard the submissions of the learned counsel for the petitioner, the learned Assistant Government Pleader for Social Welfare and the learned Assistant Government Pleader for Finance Planning.

During the course of hearing, the learned Counsel appearing for the respondents submits that the respondents does not dispute the submissions made by the petitioner with respect to the completion of the work undertaken and that the non-payment of bills is due to paucity of funds.

Considering the submissions, the concerned respondents are hereby directed to verify and release the payments due payable to the petitioner as

expeditiously as possible preferably within a period of eight weeks from the date of receipt of a copy of this order.

Accordingly, the writ petition is disposed of. No costs.

Pending miscellaneous petitions, if any, shall stand closed.
