The Court made the following Order:

The present writ petition is filed challenging the Tender Notification dated 07.06.2025 (published on 09.06.2025) vide Tender Notification No.AP AGRO/ASC/GS/WDC-PMKSY 2.0/2024-25 issued by the 1^st respondent on

the ground of not uploading the A.P.Micro-Irrigation Project (APMIP) Empanelment Letter in the e-portal, despite submitting a hard copy of the same along with the tender cover.

On perusal of the docket proceedings, it appears that the interim orders were granted in the connected W.P.Nos.15652 of 2025 and 20263 of 2025 permitting the respondents to process the tender, but not to finalize the bids until the next listing. The said orders are being extended from time to time and the same are in force.

Heard Mr.D.Harsha Vardhan, learned arguing counsel for the petitioner.

However, during the course of arguments, the learned Additional Advocate General, on instructions submits that the 1^st respondent is contemplating to withdraw the impugned Notification and issue a fresh short tender notification, more particularly, as the funds allocated by the Central Government are going to lapse. He submits that in view of the interim orders,

fresh notification could not be issued and that it would be open to the petitioner also to participate in the pre-bid meeting in respect of the proposed Tender Notification on L1 basis.

In the said circumstances and as it is open to the Tendering Authority to withdraw the notification and issue fresh tender notification, this Court, recording the submissions made by the learned Additional Advocate General, deems it appropriate to dispose of the writ petition, without going into merits of the case.

It is needless to observe that all the contentions raised in the writ petition are left open to be agitated by the petitioner, if any fresh cause of action arises. The interim orders granted by this Court in W.P.Nos. 15652 of 2025 and 20263 of 2025 shall stand dissolved.

The EMD and Security Deposits etc., on withdrawal of the Tender Notification impugned in the writ petition shall be returned to the petitioner forthwith.
