The Court made the following ORDER:

The learned counsel for the petitioner submits that the petitioner is the purchaser from the original allottee and is in possession and enjoyment of the subject property.

Heard the learned counsel for the petitioner and Sri.A.S.C. Bose, learned Standing Counsel appearing for respondent No.3.

¶40

When the matter is taken up for hearing, the learned Standing Counsel appearing for respondent No.3, on oral instructions, submits that the petitioner is in possession of certain encroached Government property and that a portion of the property is owned by the petitioner. In that regard, it is submitted that the respondents intend to conduct a proper survey in coordination with the Tahsildar and, after conducting the survey by issuing notice to the petitioner, the extent of encroachment, if any, found shall be notified and steps for reclaiming the encroached portion from the petitioner shall be taken up.

4 Recording the aforesaid submission, this writ petition is disposed of with a direction to the respondents to conduct a proper survey by issuing notice to the petitioner and also taking into account the title documents of the petitioner. Till completion of the survey, the possession and enjoyment of the petitioner

shall not be disturbed. There shall be no order as to costs.

Pending miscellaneous petitions, if any, shall stand closed.
