The Court made the following Order:-

The petitioner has been assigned the work of skill training in schools in the English language under the Tribal Welfare Department. The petitioner had successfully completed the training programme for the students. A total number of 4,500 students were trained by the petitioner. Bills for 33,472 students were cleared by the 3^rd respondent. The final bill for 11,528 students was raised by the petitioner, and the 3^rd respondent was to release an amount of Rs.61,09,840/-.

It is submitted that the petitioner has been regularly following up with the respondent authorities seeking release of the balance outstanding amount payable to the petitioner. It is submitted that the competent authority has also approved the payment due and payable to the petitioner. However, the amount has so far not been paid.

The learned Assistant Government Pleader appearing for the respondents submits that a detailed counter has been filed, and it is not denied or disputed that the amount is outstanding and due and payable to the petitioner. It is stated that the amount is due and payable. However, on account of paucity of funds, the same could not be cleared. It is also stated in the counter that appropriate correspondence has been made with the Government seeking release of the budget for clearing the balance amount payable to the petitioner. Time is sought for clearing the payment due and payable.

Considering the same and recording the contentions in the counter, the Writ Petition is disposed of, directing the respondent authorities to release the amount due and payable to the petitioner within a period of Ten (10) weeks from the date of receipt of a copy of this order. There shall be no order as to costs.

Pending miscellaneous applications, if any, shall stand closed.
