Heard Sri N.Ranga Reddy, learned counsel for the petitioner and Sri Vineeth Appasani, learned Assistant Government Pleader for Civil Supplies, for the respondents.

The petitioner was appointed as the Fair Price Shop Dealer in respect of F.P. Shop No.1228032 of Garuguchinthalapalli Village, Putlur Mandal, Ananthapuram District. The 3^rd respondent, by the proceedings vide D1CS/3172/2025 dated 07.04.2026 (Ex.P1), cancelled the authorisation, holding that the petitioner committed irregularities. The petitioner filed a statutory appeal under Clause 24(b) of A.P.S.T.P.D.S. (Control) Order, 2018 on 25.04.2026. Along with the appeal, the petitioner also filed a stay petition on the same day.

Learned counsel for the petitioner would submit that Clause 24(b) of A.P.S.T.P.D.S. (Control) Order, 2018 mandates that the appellate authority

shall dispose of the appeal within a period of sixty (60) days. He would further submit that Clause 24(b) enables the appellate authority to stay the proceedings pending disposal of the appeal. However, the appellate authority failed to exercise jurisdiction vested in it under Clause 24(b) and 24(d).

Learned Assistant Government Pleader for Civil Supplies would submit that the appellate authority will pass appropriate orders in the stay petition within a period of two (02) weeks from today. The appellate authority shall also pass appropriate orders in the appeal after affording an opportunity to the petitioner.

Given the facts and circumstances of the case, without touching the merits of the matter, the writ petition is disposed of, at the stage of admission, with the consent of both the learned counsel, directing the learned 2^nd respondent to pass appropriate orders in the stay petition filed by the petitioner within a period of two (02) weeks from today by adhering to the procedure prescribed under Clause 24(b) of A.P.S.T.P.D.S. (Control) Order, 2018. The appellate authority shall also ensure the disposal of the appeal within a period of six (06) weeks from today by affording the opportunity to the petitioner and to any other interested person. There shall be no order as to costs.

As a sequel, pending miscellaneous petitions, if any, shall stand closed.
