The Court made the following Order:

The present writ petition is filed challenging the Tender Notification dated 07.06.2025 (published on 09.06.2025) vide Tender Notification No.AP AGRO/ASC/GS/WDC-PMKSY 2.0/2024-25 issued by the 1^st respondent on various grounds.

A learned Judge of this Court while directing notice before admission on 26.06.2025, ordered that any further proceedings, in pursuance of the tender, are subject to the result of the writ petition. Subsequently, by an order dated 21.07.2025, the respondents were permitted to process the tender, but not to finalize the bids until the next listing. The said order is being extended from time to time and the same is in force.

Heard Mr.K.V.Narasimha, learned arguing counsel for the petitioners.

However, during the course of arguments, the learned Additional Advocate General, on instructions submits that the 1^st respondent is contemplating to withdraw the impugned Notification and issue a fresh short tender notification, more particularly, as the funds allocated by the Central Government are going to lapse. He submits that in view of the interim orders, fresh notification could not be issued and that it would be open to the petitioners also to participate in the pre-bid meeting in respect of the proposed Tender Notification on L1 basis.

In the said circumstances and as it is open to the Tendering Authority to withdraw the notification and issue fresh tender notification, this Court, recording the submissions made by the learned Additional Advocate General,

deems it appropriate to dispose of the writ petition, without going into merits of the case.

It is needless to observe that all the contentions raised in the writ petition are left open to be agitated by the petitioners, if any fresh cause of action arises. The interim orders granted by this Court shall stand dissolved.

The EMD and Security Deposits etc., on withdrawal of the Tender Notification impugned in the writ petition shall be returned to the petitioners forthwith.
