O R D E R :

1. This Writ Petition is filed seeking a direction to respondents to alter the date of birth of petitioner recorded in her Service Register from 10.04.1966 to 28.08.1967 on the basis of the birth certificate issued by Municipal authorities.

2. Petitioner submitted a representation dated 21.11.2022 requesting the respondents to alter the date of birth recorded in her Service Register. It is not in dispute that, at the time of her entry into service, petitioner produced her SSC certificate, wherein her date of birth was recorded as 10.04.1966. Accordingly, the said date of birth was entered in her Service Register.

3. Learned counsel for petitioner seeks a direction to the respondents to consider her representation.

4. Learned Standing Counsel appearing for respondent No.2 and learned Assistant Government Pleader submitted that the claim of petitioner is governed by the A.P. Public Employment (Recording and Alteration of Date of Birth) Rules, 1984. Rule 5 of the said Rules reads as follows:

The date of birth as determined on the basis of the school records or any proof produced at the time of entering into service and entered in the service record shall be final and no subsequent variation of date of birth in the school records for any reason, shall be relevant for the purpose of service and on that basis the date of birth entered in the service records shall not be altered except in the case of bonafide clerical error, under the orders of the Government.

A plain reading of Rule 5 makes it clear that the date of birth entered in the Service Register on the basis of the school record or other proof produced by an employee at the time of entering into service shall be final. Alteration of such date of birth is permissible only in case of a bona fide clerical error, subject to the orders of the Government.

6. In the present case, the date of birth of petitioner was entered in her Service Register as 10.04.1966 on the basis of the SSC certificate produced by her at the time of entering into service. Petitioner now seeks alteration of the said date to 28.08.1967 on the basis of a birth certificate subsequently issued by the Municipal authorities. Such a subsequent document cannot, in the absence of a bona fide clerical error in the original entry, constitute a valid ground for alteration of the date of birth recorded in the Service Register. Therefore, petitioner has not made out any ground for directing the respondents to alter her date of birth from 10.04.1966 to 28.08.1967.

7. Accordingly, the Writ Petition is dismissed . No order as to costs.

Interim orders, if any, granted earlier shall stand vacated, and all pending miscellaneous petitions, if any, shall stand closed.
