ORDER:

This Writ Petition is filed under Article 226 of the Constitution of India seeking the following prayer;

“….pleased to issue an order, direction or writ, more particularly one in the nature of writ of Mandamus, declaring the action of the respondents in unilaterally imposing and demanding the petitioner to pay the pending exorbitant enhanced license fee of Rs.28,21,718/- on 19.11.2025 for the shop of the petitioner in Shop No.11, Sector 3, Ukkunagaram Township Area of Visakhapatnam and subsequently disconnecting the electrical supply for the shop of the petitioner on 21.11.2025 for being illegal, arbitrary, in violation of the principles of natural justice and Article 21 and 19 (1) (g) of the Constitution of India and consequently direct the respondents not to unilaterally impose such exorbitant license fees on the petitioner and not to disconnect amenities like electricity and water, and pass .”

Case of the petitioner herein is that the petitioner was initially allotted Shop No.11 in Sector-3 in Ukkunagaram by Mahila Samithi in the year 1996. Subsequently, an order of allotment was issued by

the Town Administration Department on 20.04.2001. Since then, the petitioner has been running a canteen and catering service, catering to the needs of the residents of the Steel Plant Township. The shop was allotted to the petitioner after considering his application. There are about 6,800 quarters in the Steel Plant Township with nearly 5,000 residents living in them, and there are about 156 shops in the township. Grievance of the petitioner is that the respondents imposed an exorbitant license fee of Rs.28,21,718/- for the aforesaid shop on 19.11.2025 and subsequently disconnected the electricity supply to the shop being run by the petitioner on 21.11.2025, without issuing any prior notice.

Learned counsel for the petitioner submits that a representation dated 13.06.2025 has been made to respondents, mentioning the difficulties being faced by the petitioner, but no action has been taken by the respondents.

In view of the contents of the representation made by the petitioner herein, this Court is of the opinion that, without going into the merits of the case, it would be appropriate to direct the respondents to dispose of the representation dated 13.06.2025 submitted by the petitioner in accordance with law within a period of four (4) weeks from the date of receipt of a copy of this order.

Accordingly, the Writ Petition is disposed of directing the respondents to dispose of the representation dated 13.06.2025 submitted by the petitioner in accordance with law within a period of four (4) weeks from the date of receipt of a copy of this order . No costs.

As a sequel, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
