Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue an appropriate writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the 3rd respondents in not taking any action on the complaint/representation dated 27.01.2025 and 13.02.2025 which was filed under Sec 4, 5, 23, 24 of The Maintenance and Welfare of Parents and Senior Citizens Act, 2007 is illegal arbitrary and violative of Article 14, 21 and 300A of the Constitution of India and consequently direct the 3 respondent to take immediate steps for provide the facilities like food, shelter and Medical Facilities as per Sec 4, 5, 23, 24 of The Maintenance and Welfare of Parents and Senior Citizens Act, 2007

The Court made the following Order:

Heard Sri J.M. Naidu, learned counsel for the petitioner, learned Assistant Government Pleader for Revenue for the respondent Nos.1 to 4 and learned Assistant Government Pleader for Women Development and Child Welfare for the respondent No.5.

The grievance of the petitioner is against the inaction on the part of the 3^rd respondent in passing orders on the applications filed by the petitioner, dated 27.01.2025 and 13.02.2025 under the provisions of the Maintenance and Welfare of Parents and Senior Citizens Act, 2007.

When the matter has been taken up for consideration today, the learned Assistant Government Pleader for Women Development and Child Welfare has placed a copy of instructions received by him in the case. A perusal of the same would reflect that despite of issuance of several notices by the 3^rd respondent, the petitioner did not responded to the notices. Even a telephonic call was made, however the authorities could not reach out to the petitioner. However as a last chance to the petitioner, the matter was adjourned to 30.12.2025 and it is stated that even on the said date the petitioner did not appear. Learned Assistant Government Pleader further submits that the next date fixed for hearing is 09.01.2026.

Learned counsel for the petitioner submits that on the said date, the petitioner would appear before the respondent No.3-Revenue Divisional

Officer without fail. He further informs the Court that the next date of hearing has been noted by his client, as well.

Having regard to the contentions advanced, this Court deems it appropriate to dispose of the Writ Petition directing the respondent No.3 – Revenue Divisional Officer, Vijayawada, NTR District to pass appropriate orders on the applications filed by the petitioner as expeditiously as possible preferably within a period of three (03) weeks from the date of receipt of the order in accordance with law. It is made clear that if the petitioner fails to appear on the next date of hearing, the Revenue Divisional Officer is at liberty to pass appropriate orders basing on the material available on record.
