Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue an appropriate Writ, Order or direction more particularly one in the nature of Writ of Mandamus declaring the inaction of the respondents in releasing the net amounts of Rs.8,01,118/- (Rupees Eight Lakhs One Thousand and One Hundred and Eighteen Rupees Only) towards the work duly executed by me as arbitrary, illegal and well established legal principles apart from being violative of the fundamental and Constitutional rights guaranteed to me under Articles 14, 19, 21 and 300-A of the Constitution of India and consequently direct the respondents pay the amount of Rs.8,01,118/- (Rupees Eight Lakhs One Thousand and One Hundred and Eighteen Rupees Only) and pass

The Court made the following Order:

Heard the learned counsel for the petitioner, learned Assistant Government Pleader for Social Welfare for the respondent Nos.1, 3 to 6 and learned Assistant Government Pleader for Finance Planning for the respondent No.2.

This Writ Petition is filed seeking a direction to the respondents to pay a sum of Rs.8,01,118/-, which is due to the petitioner towards the works executed by the petitioner.

When the matter has been taken up for consideration today, the learned Assistant Government Pleader for Social Welfare, appearing for the respondents, has placed before the Court, a copy of instructions received by him in the case. A perusal of the same would reflect that an amount of Rs. 8,01,118/- is payable to the petitioner. The said amount has already been sanctioned and shall be paid to the petitioner upon obtaining permission from the competent authority for the continuation of NABARD Tranche-XXII.

Having regard to the above, this Court deems it appropriate to dispose of the Writ Petition directing the respondents to release the amounts that are due to the petitioner within a period of eight (08) weeks from the date of receipt of the order.
