The petitioner herein filed the present petition under Section 24 of the Code of Civil Procedure, 1908, (for short ‘ the C.P.C. ’ ) seeking to withdraw F.C.O.P.No.1053 of 2024, on the file of the XIV Additional District Judge-cumAdditional Family Court at Vijayawada, Krishna District and transfer the same to the file of the IV Additional District Judge-cum-Principal Family Court, Vijayawada, Krishna District, for trail and disposal of the same.

Learned counsel for the respondent submitted that they have no objection to the transfer of the said F.C.O.P. No.1053 of 2024, which is pending before the XIV Additional District Judge-cum-Additional Family Court, Vijayawada, Krishna District, to the file of the IV Additional District Judge-cum-Principal Family Court, Vijayawada, Krishna District, since another matter between the same parties is already pending before the Principal Family Court at Vijayawada.

On considering the submissions made by the learned counsel appearing for both sides on record, the F.C.O.P.No.1053 of 2024 on the file of the XIV Additional District Judge-cum-Additional Family Court at Vijayawada, Krishna District, is hereby withdrawn and transferred to the file of the Principal Family Court, Vijayawada, Krishna District. The learned XIV Additional District Judgecum-Additional Family Court at Vijayawada, Krishna District, shall transmit the entire case record in F.C.O.P.No.1053 of 2024, to the file of the Principal Family Court, Vijayawada, Krishna District, duly indexed as expeditiously as possible preferably within a period of two (02) days from the date of receipt of a copy of the order. Both the parties are directed to appear before the Principal Family Court, Vijayawada, Krishna District, on 02.02.2026, at 10.30 a.m.

In the result the Transfer Civil Miscellaneous Petition is allowed . There

shall be no order as to costs.

As a sequel, miscellaneous petitions, if any pending and the Interim order granted earlier, if any, shall stand closed.
