The Court made the following Order:

The respondent No.1 herein had filed O.S.No.157 of 2018 on the file of Principal Civil Judge (Junior Division), Tenali, for evicting the appellant and also for arrears of rent and damages. This Suit was decreed on 23.11.2022. Aggrieved by the said judgment and decree, the appellant approached the Principal Civil Judge (Senior Division), Tenali, by way of A.S.No.179 of 2024.

This appeal came to be dismissed on 28.07.2025. Aggrieved by the said order of dismissal, the appellant has approached this Court by way of the present Second Appeal.

The matter was heard on 06.02.2026. After completion of hearing, the learned counsel appearing for the appellant, sought time, to enable the appellant, to file an affidavit of undertaking that, she would vacate the suit schedule premises within six (06) months.

Today, when the matter is called, the appellant and the learned counsel appearing for the appellant are present. The affidavit filed by the appellant states that, she solemnly undertakes to vacate and handover the peaceful and vacant possession of the suit schedule premises, within a period of six (06) months from the date fixed by this Court, without seeking further extension of time. Further, she stated that, she would not induct any third party into the premises; nor create any encumbrance or sub-lease; nor cause any damage to the premises.

In view of the aforesaid undertaking, this appeal is dismissed, with liberty to the appellant to remain in peaceful possession of the property, till she vacates and hands over the peaceful possession of the property, to the respondents within six (06) months, from 01.03.2026.

Needless to say, the appellant shall also pay, the rent for the six (06) months, as well as, the earlier period of time, during which she has been in possession, at the rate of Rs.5,000/- per month.

Accordingly, the present Second Appeal is dismissed in terms of the above. There shall be no order as to costs.

As a sequel, pending miscellaneous applications, if any, shall stand closed.
