COMMON JUDGMENT :

Today when the matter is taken up for hearing, learned counsel for the appellant contended that they have filed a Memo dated 16.03.2026, along with the letter of the party before the Registry, seeking to withdraw the second appeal against the respondent No.2 and the learned counsel for the appellant also endorsed the same on the grounds of appeal.

Perused the Memo filed by the learned counsel for the appellant and the appellant is permitted to withdraw the second appeal as against the respondent No.2.

Accordingly, the second appeal against the respondent No.2 is dismissed as withdrawn.

I.A.No.1 OF 2026 IN/AND S.A.No.290 OF 2021:

I.A.No.1 of 2026 is filed seeking to record the memorandum of compromise dated 17.02.2026, arrived at between the appellant and the respondent No.1 in S.A.No.290 of 2021, by incorporating the terms and conditions as part of the decree in S.A.No.290 of 2021.

Today when the matter is taken up for hearing, the appellant and the respondent No.1 are present and the learned counsel appearing for both sides are also present and they have identified their respective parties. Learned

counsel appearing for both sides represented that the present second appeal

in between the appellant and the respondent No.1 has been settled out of the Court and they have entered into the terms of compromise. The appellant and the respondent No.1 produced Photostat copies of aadhaar cards in proof of their identity and they have represented that they compromised the matter by way of memorandum of compromise and the second appeal may be disposed of by recording the same.

In view of the same, I.A.No.1 of 2026 is allowed recording the memorandum of compromise and S.A.No.290 of 2021 is disposed of in terms of the compromise arrived at between the parties.

Pending miscellaneous applications, if any, shall stand disposed of in consequence. No costs.

The Registry is directed to annex a copy of the memorandum of compromise to this judgment.
