This Civil Revision Petition has been filed seeking a

direction to the learned VI Additional District Judge-cum-Family Court, Kadapa, to dispose of IA No.649 of 2024 in OS No.21 of 2020, as expeditiously as possible.

Case of the petitioners is that, 1^st respondent herein/plaintiff filed OS No.21 of 2020 on the file of the learned Judge, Family Court-cum-VI Additional District Judge, Kadapa, against the petitioners herein/D1 and D2 and 2^nd respondent herein/D3, for specific performance of contract in respect of the suit schedule property and to restrain 1^st petitioner herein/1^st defendant from alienating the suit schedule property to others by means of permanent injunction. In the said suit, after examining PWs.1 to 3, the defendants were set ex parte and an ex parte decree was passed on 16.08.2022. The plaintiff managed to return the suit summons as ‘addressee left to Kuwait’ and obtained an ex parte decree in the suit. The petitioners came to know about the said decree only after receiving the order of delivery of possession passed in EA No.42 of 2024 in EP No.53 of 2023 in OS No.21 of 2020. Immediately, the petitioners herein/D1 and D2 filed IA No.649 of 2024 in OS No.21 of 2020 seeking to condone the delay of 729 days in filing the petition to set aside the ex parte decree dated 16.08.2022. Though there is urgency in the matter, the trial Court is not disposing of the said IA. Hence, they filed the present CRP praying to direct the Court below to dispose of the said IA as expeditiously as possible.

In view of the aforesaid facts and circumstances, without going into the merits of the case, the learned Judge, Family Court-cum-VI Additional District Judge, Kadapa, is directed to dispose of IA No.649 of 2024 in OS No.21 of 2020, in accordance with law, as expeditiously as possible, preferably within a period of six (6) weeks from the date of receipt of a copy of this order.
