Heard learned counsel for the petitioner.

Notice to the respondent No.2 is deemed not necessary as the Revision Petition is disposed of, without going into merits of the case.

Petitioner / claimant in L.A.O.P.No.2 of 2024 on the file of the Court Civil Judge (Senior Division), Amalapuram filed the present Revision Petition. He made an application vide I.A.SR.No.591 of 2026 dated 26.02.2026 seeking issuance of a cheque in his favour for an amount of Rs.24,92,778/-, which is stated to be lying in the Civil Court deposit. The said amount according to the learned counsel for the petitioner is compensation for the land acquired from the petitioner. He submits that instead of entertaining the application and passing appropriate orders thereon, the same is returned on 16.07.2026 with an endorsement ‘amount kept in Hon’ble II Additional District Court, Amalapuram. Hence returned.’ He submits that the said return without passing appropriate orders in the I.A., preferred by the petitioner by numbering the same, is not tenable. Therefore, the petitioner is constrained to file the present Revision Petition and seeks appropriate directions.

Considered the submissions made. When an application is filed, it is incumbent upon the learned Trial Court to examine the same and number it if it is in order. Thereafter, a duty is cast on it to pass appropriate orders in the said I.A. In the present case, the said procedure is not followed and the application filed by the petitioner is simply returned. Be that as it may.

In the facts and circumstances, it is deemed appropriate to dispose of the Revision Petition, providing that the learned Civil Judge (Senior Division), Amalapuram shall take up the I.A., by numbering the same, if it is otherwise in order and pass appropriate orders thereon, in accordance with the Law, after giving due opportunity to all the concerned parties, as expeditiously as possible, within a period of six (6) weeks from the date of receipt of a copy of this order.

Registry is directed to return the original documents including the returned I.A., to the learned counsel for the petitioner.

Accordingly, the Civil Revision Petition is disposed of. No costs.

As a sequel, all the pending miscellaneous applications, if any, shall
