C.R.P. No. 2521 of 2026 is filed under Article 227 of the Constitution of India aggrieved for non-disposal of I.A. No. 176 of 2023 in O.S. No. 109 of 2023 on the file of the Court of the Civil Judge (Junior Division), Madakasira, filed under Order XXXIX, Rules 1 & 2 of C.P.C. seeking temporary injunction restraining the respondent and her men, agents from interfering with the petitioner’s peaceful possession and enjoyment of the schedule property.

2. C.R.P. No. 2523 of 2026 is filed under Article 227 of the Constitution of India aggrieved for non-disposal of I.A. No. 331 of 2025 in I.A. No. 176 of 2023 in O.S. No. 109 of 2023 on the file of the Court of the Civil Judge (Junior Division), Madakasira, filed under Section 151 C.P.C. seeking police aid.

3. The revision petitioner filed the suit in O.S. No. 109 of 2023 seeking permanent injunction. Along with the suit, I.A. No. 176 of 2023 was filed seeking interim injunction. On 13.06.2023, the trial Court granted ad-interim injunction till 30.06.2023 in favour of the revision petitioner.

The learned counsel for the revision petitioner submitted that the trial Court extended the interim order from time to time for some time and later it was not extended, but since the interim application had also not been disposed, C.R.P. No. 2521 of 2026 had been filed for early disposal of I.A. No. 176 of 2023.

5. When the extended interim order was not in force, I.A. No. 331 of 2025 was filed seeking police aid for the purpose of implementation of the interim order and as the same was also not quickly disposed, C.R.P. No. 2523 of 2026 was filed.

6. As per the submissions of the learned counsel for the revision petitioner, I.A. No. 176 of 2023 is ripe for hearing as counter had been filed, and the same needs to be adjudicated as early as possible, since the revision petitioner is not able to get the usufruct from the plaint schedule property.

7. Since the interim order granted earlier had not been extended after some time, hearing I.A. No. 331 of 2025 does not help the petitioner, but pendency of I.A. No. 176 of 2023 despite of readiness of the revision petitioner for enquiry causes hardship. Therefore, the trial Court shall dispose of I.A. No. 176 of 2023 as early as possible without any further delay.

8. Accordingly, C.R.P. No. 2521 of 2026 is disposed of directing the trial Court to hear both the parties and dispose of I.A. No. 176 of 2023, as early as possible, not later than one (1) month from the date of receipt of copy of this order.

9. In view of the foregoing discussion, C.R.P. No. 2523 of 2026 is closed as no order is required.

There shall be no order as to costs.

Pending miscellaneous applications, if any, shall stand closed.
