The Criminal Petition has been filed under Section 482 of the Code of Criminal Procedure, 1973 (for brevity, 8the Cr.P.C.,9)/Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity, 8the BNSS9), seeking to quash the proceedings in C.C.No.140 of 2022 (Crime No.13 of 2018 of Chintalapudi Police Station) on the file of the learned Judicial First Class Magistrate, Chintalapudi, registered for the offences punishable under Sections 420, 465, 468, 471 of the Indian Penal Code, 1860 (for brevity, 8the IPC9).

Heard Sri B. Chandra Sekhar, learned counsel for the petitioner, the learned Assistant Public Prosecutor, and Ms. Shaik Sultana, learned counsel for respondent No.2. Perused the record.

As seen from the record, the petitioner is a terminated contract employee of the Medical and Health Department. Respondent No.2 lodged a complaint with L.W.8 stating that the petitioner had obtained employment by producing certain fake documents. The said complaint was registered as a case in Crime No.13 of 2018 by the Station House Officer, Chintalapudi Police Station, for the offences punishable under Sections 420, 465, 468 and 471 of 8the IPC9. After conducting investigation, the Investigating Officer laid the charge sheet against the petitioner.

It is important to note that the Enquiry Officer, after conducting an enquiry, submitted a report to the District Medical and Health Officer stating that the petitioner, Chalgani Narsimha Raju, had not indulged in any misconduct. The Enquiry Officer further opined that the genuineness of the appointment of two Family Welfare Workers, namely Mallireddy Ramu and Chalgani Narsimha Raju (the petitioner), working under the control of the District Medical and Health Officer, West Godavari, on contract basis, could not be judged due to the lack of the original recruitment file of the Family Welfare Workers. It was further opined that the office of the District Medical and Health Officer, Eluru, misled the higher authorities by including their names in the list of regular contract employees though they were appointed on an outsourcing basis.

It is also pertinent to point out that the said Mallireddy Ramu had faced criminal proceedings in Crime No.57 of 2018 for the offences punishable under Sections 420 and 468 of 8the IPC9 on a similar set of facts and circumstances. However, the Investigating Officer filed a final report, as seen from the case diary dated 15.11.2018, stating that the case against Mallireddy Ramu was action dropped.

In the instant case also, the petitioner stands on the same footing as Mallireddy Ramu. Therefore, there is no justification to continue the proceedings on the file of the learned Judicial First Class Magistrate, Chintalapudi, as it would amount to abuse of the process of law.

Accordingly, the Criminal Petition is allowed, and the proceedings against the petitioner/Accused in C.C.No.140 of 2022 (Crime No.13 of 2018 of Chintalapudi Police Station) on the file of the learned Judicial First Class Magistrate, Chintalapudi, are hereby quashed.

As a sequel, Miscellaneous petitions, if any pending, shall stand closed.
