JUDGMENT:

When the matter is taken up for hearing, the learned counsel representing the appellant/accused and the learned Additional Public Prosecutor representing the respondent–State submitted that the appellant/accused had passed away on 02.03.2024 during the pendency of the appeal.

In this regard, the prosecution has placed on record the Death Certificate of the appellant/accused, issued on 13.03.2024 by the Department of Health, Medical and Family Welfare, Grama Panchayat, Chinnakotla.

In view of the submissions made by the learned counsel on either side, and as none of the legal representatives of the deceased appellant/accused have come forward seeking leave to continue the appeal, as contemplated under Section 394 of the Code of Criminal Procedure, the appeal stands abated against the appellant/accused under Section 394 of the Code of Criminal Procedure.
