Heard learned counsel representing Sri Sivaprasad Reddy Venati, learned counsel for the appellant/complainant and learned counsel representing Sri Venkat Rao Ravulapalli, learned counsel for the respondent/accused and Sri C.Panini Somayaji, learned Additional Public Prosecutor representing the State.

Learned counsel for the appellant would submit that the matter has been settled out of the Court and, therefore, the appellant may be permitted to withdraw the appeal.

The appeal was filed by the complainant challenging the order of acquittal rendered by the learned Magistrate for the offence under Section 138 of the Negotiable Instruments Act, 1881.
