JUDGMENT: (per Ravi Nath Tilhari, J)

The appellant is the respondent in M.O.P.No.88 of 2008 on the file of the Court of the Additional Senior Civil Judge, Srikakulam. The said M.O.P., was filed by the respondent/petitioner seeking a decree of divorce by dissolution of the marriage solemnized between the parties on 14.05.2003. The learned Court allowed the petition and granted a decree of divorce dissolving the marriage. Challenging the said order, the present CMA has been filed under section 28 of Hindu Marriage Act.

Today, when the matter is taken up for hearing, there is no representation on behalf of the appellant.

Sri Aravala Rama Rao, learned counsel for the respondent submits that the matter has been settled before the learned Trial Court.

On perusal of the record, it is seen that the Mediation Center has submitted a report dated 20.02.2026, indicating that the mediation was conducted on 25.07.2025. As per the mediator’s report, the matter had already been settled between the parties before the learned Trial Court. The compromise agreement dated 23.06.2012 has been filed along with the report.

Upon perusal of the agreement dated 23.06.2012 annexed to the mediator report, it is not evident whether the said compromise was entered

into before the Court, acted upon pursuant to any Court order, or was an out

of court settlement.

So, without observing if such settlement dated 23.06.2012 was in the learned Trial Court as mentioned in the report of the mediation, but as the appellant’s counsel is not present, the Civil Miscellaneous Appeal is dismissed for want of prosecution. There shall be no order as to costs.

As a sequel thereto, miscellaneous petitions, if any pending, shall also stand closed.
