This appeal has been filed by the appellant/wife, being aggrieved by the judgment and decree dated 28.03.2008 passed in H.M.O.P. No.101 of 2005 on the file of the Principal Senior Civil Judge, Kakinada, whereby the petition filed by the respondent/husband under Section 12(1)(c) of the Hindu Marriage Act, 1955 was allowed granting a decree of divorce.

2. On 2.03.2026 the following order was passed:

“The present appeal has been filed by the appellant/wife, challenging the decree of divorce granted on the petition instituted by the respondent/husband.

¶35

2. On 18.10.2008, a Co-ordinate Bench granted interim suspension of the divorce decree.

¶36

3. On 03.02.2026, the matter was adjourned at the request made on behalf of the appellant’s counsel, and on 18.02.2026, time was granted to obtain instructions.

4. Today also, learned counsel for the appellant seeks an adjournment.

¶38

5. Considering the nature of the appeal and the subsisting interim order, one final opportunity is granted to the appellant to obtain instructions.

6. As last opportunity, list after three (03) weeks.

Learned counsel for the appellant submits that the respondent/husband has died and that he has received oral instructions from the brother of the appellant/wife that she is not inclined to pursue further prosecution.
