Petition under Sections 10 to 12 of Contempt of Courts Act 1971 praying that in the circumstances stated in the affidavit file herein the High Court may be pleased to May be pleased to summon the Respondents herein and punish the Respondents for willfully disobeying the orders of this Hon’ble court passed in IA.No.2 of 2025 in WP.No.19326 of 2025, dated 18-09-2025, by this Honble Court, under sections 10 to 12 of the Contempt of Courts Act and pass such other orders.

CONTEMPT CASE No.4075 of 2025

ORDER:

The present Contempt Case is filed for non-compliance of the interim order dated 18.09.2025 passed by this Court in I.A.No.2 of 2025 in W.P.No.19326 of 2025, wherein this Court had passed the following interim order;

“Considering the fact that the petitioner had retired from service on 31.07.2024 i.e. nearly fifteen (15) months have elapsed there from, this court issued the following interim directions;

(i) The Respondents shall fix the provisional pension amount payable to the Petitioner and pay the same from the date of due i.e. from 01.08.2024 till date, within a period of four (4) weeks from today;

(ii) The Respondents shall also consider releasing of leave encashment and 80% of gratuity as provided under G.O.Rt.No.1097, dated 22.06.2000 within a period of four (4) weeks from today;

(iii) The Respondents shall also release GIS amounts due to the Petitioner since the same cannot be withheld with the Respondents within a period of four (4) weeks from today.”

The learned counsel for the Petitioner submits that the Surrender

Leave amount was not paid to the Petitioner. In reply, the counsel for the Respondents would submit that the same would be complied with as expeditiously as possible.
