A letter, dated 08.09.2026, has been addressed to the Registry by the learned Counsel appearing for the Appellant, stating that the matter has been amicably settled between the parties before the elders, outside the Court, and that, on the instructions of the Appellant, he seeks permission to withdraw the Appeal. The said letter is accompanied by a letter stated to have been addressed by the Appellant to his learned Counsel.

Learned Counsel for the Appellant further submitted that, in view

of the settlement arrived at between the parties, the Appellant be permitted to seek refund of the Court fee.

Having regard to the submissions made by the learned Counsel for the Appellant, the letter addressed to the Registry and the instructions stated to have been furnished by the Appellant, and as no further cause survives for adjudication in the Appeal, the Appeal is dismissed as withdrawn. No order as to costs.

It is open to the Appellant to move an appropriate application before the competent Court for refund of the Court fee, in accordance with law.
