the nature of writ of mandamus by declaring the action of Respondent No.2 in issuing order on 30-12-2022 vide RO/ HRD/ DAD/ 2022-23/402, by imposing the punishment Dismissal of Service as illegal, arbitrary, unconstitutional and in violation of Article 14,19,21, of our Indian constitution, and consequently direct the respondent no.2 to set aside order on 30-12-2022 vide RO/HRD/DAD/2022-23/402 and to pass such other order.

ORDER:

The present Writ Petition is filed questioning the action of Respondent No.2 in issuing Order vide RO/HRD/DAD/2022-23/402, dated 30.12.2022 imposing the punishment “Dismissal of Service”, as illegal and arbitrary.

The Petitioner while working as Senior Manager in the Respondent-Bank, a Charge Memorandum was issued vide HRD: GUNTR: 2021-22: 249 on 25.01.2022, wherein an Article of Charge was framed stating that the Petitioner had claimed an amount of Rs.22,320/- (Sanctioned amount of Rs.21,240/-) vide T.A. Bill for staying in the hotel ‘Prathap Residency’ at Proddatur from 15.07.2021 to 29.07.2021 is suspected to be fake. On enquiry, the Petitioner was imposed punishment of “Dismissal” as per the Regulation 4(J) of Central Bank of India Officers’ (Discipline and Appeal) Regulations, 1976. Questioning the same, the present Writ Petition came to be filed.

Today, when the matter is taken up for hearing, the learned counsel for the Petitioner would submit that an appeal is filed before the Appellate Authority i.e. Respondent No.2 on 26.06.2023 and the same is not being considered. He further submits that for the present, he is

only seeking direction to the Appellate Authority for disposal of the appeal, granting liberty to re-agitate the impugned order of “Dismissal” in the event the appeal is rejected.

Learned Standing Counsel appearing for the Respondent-Bank would submit that the appeal was filed beyond the time stipulated and therefore the appeal is not being considered by the Appellate Authority.

Having heard the respective counsel, this Court is inclined to dispose of the Writ Petition with the following directions;

(i) The Respondent authorities are directed to consider the appeal filed by the Petitioner on 26.06.2023 questioning the impugned order passed by Respondent No.2 dismissing the Petitioner from service before the Appellate Authority;

(ii) The Appellate Authority shall consider the appeal on merits and dispose of the same, as expeditiously as possible.

(iii) No order as to costs.

Accordingly, the Writ Petition is disposed of.

As a sequel, pending applications, if any, shall stand closed.
