The writ petition is filed seeking a direction to the 4^th respondent to allow the petitioner to supply/provide food to the Students at Government College of Nursing, Kurnool in accordance with the agreement dated 30.06.2023.

Learned counsel for the petitioner submits that the petitioner has been maintaining & operating the students mess at the Government Nursing College, pursuant to an agreement with the students committee to supply food to the students at the rate of Rs.1,700/- per student per month. In compliance with the said agreement, the petitioner has been supplying food to the students. However, the 4^th respondent is not allowing the petitioner to operate from the premises or use the kitchen located within the Government Nursing College.

Learned Assistant Government Pleader for Medical and Health appearing for the respondents would submit that there is no formal agreement between the petitioner and the respondents. The subject agreement was executed unilaterally by the petitioner. The hospital authorities are not parties to the said agreement. It is further submitted that the petitioner had in fact given an undertaking to vacate the premises, as and when the employees of the college take charge of the canteen.

Considered the submissions made by the learned counsel for the petitioner and the learned counsel for the respondents. Perused the record. It appears that the petitioner has submitted an undertaking stating that she would vacate the premises, as and when the regular employees are posted to

manage the kitchen facilities. In light of the fact that, the petitioner has been supplying food to the students since 2023, this Court deems it appropriate to direct the respondents to issue a one-month prior notice to the petitioner if it is proposed to get the 4^th respondent vacated from the subject premises. Upon expiry of such notice, the petitioner shall vacate the said premises.
