Scheme on Gundlakamma River in Vinukonda Mandal of Guntur District as illegal, arbitrary, unconstitutional and direct the respondents to immediately pay the due amount of Rs.12,10,991/- along with interest at 16.5percent p.a. payable to the petitioner in relation to the works done by the petitioner and to pass

The present Writ Petition came to be filed under Article 226 of the Constitution of India seeking the following relief:-

“ …to issue a Writ or Direction more particularly one in the nature of Writ of Mandamus declaring the action of the 4^th and 5^th respondents in not releasing the amount of Rs.12,10,991/- even after finalizing the bills payable to the petitioner in relation to the work of Renovation of Ummadivaram L.l. Scheme on Gundlakamma River in Vinukonda Mandal of Guntur District as illegal, arbitrary, unconstitutional and direct the respondents to immediately pay the due amount of Rs.12,10,991/- along with interest at 16.5 % p.a. payable to the petitioner in relation to the works done by the petitioner…”

Today when the matter came up for hearing, the learned Standing Counsel representing respondent Nos.3 to 5, has furnished a copy of instructions of respondent No.3, wherein it is admitted that the Executive Engineer, APSIDC Division has prepared the LS 1^st & Final bill of Rs.12,87,613/- for work bill and Centage charges of Rs.1,75,307/-. It is further stated that all efforts are being made to arrange the payment to the agency by uploading the work bills in the NIDHI Portal and payments will be arranged soon after mapping the bill in NIDHI Portal under DDO Code (06011225001).

In view of the amounts admitted to be payable by respondent Nos.3 to 5, the Writ Petition is disposed of, directing respondent Nos.3 to 5 to make the payment as admitted, within a period of two (02) months from the date of receipt of copy of this order. No costs.
