Heard Sri J.U.M.V. Prasad, learned counsel for the petitioner,

learned Assistant Government Pleader for Women Development Child Welfare and Smt. B.V. Aparna Lakshmi, learned counsel appearing for the respondent No.6.

Challenging the Show Cause Notice, dated 21.10.2024 issued

by the respondent No.5 against the petitioner, the petitioner filed the instant writ petition.

It is contended by the petitioner that the petitioner was asked to show cause as to why an appropriate action should not be taken against the petitioner, having regard to the fact that the study certificate produced by the petitioner at the time of joining the School as ‘Aaya’ is found to be a genuine certificate. To the said show cause notice, the petitioner has submitted her explanation on 23.10.2024. Challenging the show cause notice, the present writ petition is filed.

When the matter is taken up for hearing today, learned Assistant Government Pleader appearing for the respondents has placed a copy of instructions received by him from the 5^th respondent. A perusal of the same would reflect that pursuant to the complaint, the 5^th respondent has passed orders vide proceedings R.C.No.B/52/2024, 17.09.2024 and the same was sent to the petitioner for explanation. However, the petitioner refused the same. Thus the notice sent to the petitioner was returned unserved.

Learned counsel for the petitioner submits that the respondents should atleast place before the Court as to when the proceedings were said to have been sent, was returned unserved. In the absence of the same, it cannot be said that the petitioner has refused it.

However, during the course of arguments, learned Assistant Government Pleader appearing for the 5^th respondent has produced a copy of the final orders passed pursuant to the show cause notice and a copy of the same has been handed over to the learned counsel for the petitioner. From a perusal of the same, it would reveal that the petitioner was terminated with immediate effect, as she secured appointment as Anganwadi helper by producing fake study certificate.

Therefore, learned counsel for the petitioner seeks liberty to challenge the said proceedings by way of an appropriate writ petition.

Since, after issuance of the show cause notice, dated 21.10.2024, the final orders, dated 19.02.2025 also have been passed. However, the cause raised in the present writ petition would not survive. In view of the same, the petitioner is at liberty to challenge the proceedings, dated 19.02.2025.
