Heard Sri Subba Rao Korrapati, learned counsel for the petitioner and

learned Assistant Government Pleader for Women Development and Child Welfare, appearing for the respondents.

Being aggrieved by the action of the 2^nd respondent in not

¶25

disposing of the application filed by the petitioner seeking maintenance under

¶26

¶27

the provisions of the Maintenance and Welfare of Parents and Senior Citizens Act, 2007, the instant Writ Petition has been filed.

It is contended that after the death of the petitioner’s husband, the petitioner performed the respective marriages of her children, who are now settled in their lives but are not taking care of her. As a result, she approached the 2nd respondent for the grant of maintenance of Rs.30,000/- per month. The said application was filed on 25.07.2024. However, no orders have been passed so far for interim maintenance, which compelled her to approach this Court.

When the matter is taken up for hearing, the learned Assistant Government Pleader for Women Development and Child Welfare, has placed on record a copy of the instructions received by him in the case. A perusal of the same would reflect that the son of the petitioner presently is living in London and notices have been issued to both the petitioner and her children. Since her son is residing in London, he did not appear on the date fixed for enquiry, which was on 10.03.2025. However, a reply was sent through an email. It is stated that the matter is currently under enquiry.

The said written instructions of the 2^nd respondent are placed on

Having regard to the circumstances of the case, this Court is of

the considered view that the Writ Petition can be disposed of directing the 2^nd

respondent to dispose of the application filed by the petitioner within a time-bound manner.

Accordingly, the Writ Petition is disposed of, directing the 2^nd respondent to pass appropriate orders on the application filed by the petitioner seeking maintenance interim maintenance within a period of two (2) weeks from the date of receipt of the orders. There shall be no order as to costs.

As a sequel, interlocutory applications, pending if any, shall stand

closed.
