ORDER:

This writ petition is filed aggrieved by the action of the respondents for non-payment of the bills for the works undertaken by the petitioner.

Heard the submissions of the learned counsel for the petitioner, the learned Government Pleader for Municipal Administration and Urban Development, the learned Assistant Government Pleader for Finance and Planning, and the learned Standing Counsel for the respondentCorporation.

The learned counsel for the petitioner submits that the 7^th respondent entrusted the works to the petitioner under agreement No.474/202324/EE-VA/GVMC, dt.20.12.2023. The details of the work are, repairs to internal CC roads and CC drains in Dharma Nagar, Secretariat No.1086261 in ward No.55 of Zone-VA, with the respective specifications as mentioned in the agreement.

The learned counsel further submits that the petitioner duly executed the work to the satisfaction of the 7^th respondent. It is further submitted that after execution of the works, the progress of the work was recorded in the M book and the quality of the work done by the petitioner was also assessed by the authority, who was employed by the 7^th respondent. Later, the petitioner submitted a final bill. The authorities of the 7^th

respondent admitted the final bill and approved the bill for a sum of Rs.12,57,898/- after deducting necessary charges and other expenses, but so far no payment has been made to the petitioner.

The learned standing counsel for respondents 5 to 7, on oral instructions, submits that the works undertaken by the petitioner were completed to the satisfaction of respondents 5 and 7, however, due to insufficient funds, the payment could not be made to the petitioner and that the payment would

be made in due course.

Considering the submissions that the work completed by the petitioner is not in dispute, there shall be a direction to respondents 2 and 5 to verify and release the payments due payable to the petitioner within a period of four weeks.

With the above direction, the writ petition is disposed of. No costs.

Pending miscellaneous petitions, if any, shall stand closed.
