This writ petition is filed aggrieved by the action of the respondents for non-payment of the bills for the works undertaken by the petitioner.

Heard the submissions of the learned counsel for the petitioner, the learned Government Pleader for Municipal Administration and Urban Development, the learned Assistant Government Pleader for Finance and Planning, and the learned Standing Counsel for the respondentCorporation.

The learned counsel for the petitioner submits that the 3^rd respondent entered into different agreements with the petitioner for the construction and repair works. The details of the respective works are, (i) renovation of existing 1^st floor in municipal office under agreement No.38/2023-24, dt.28.07.2023, for Rs.23,45,239/-; (ii) repairs to 110 HP motor at Gollapudi, providing winding to 40 HP motor at Gollapudi and supply of 250 mm dia non return valve to WTP under agreement No.320/JTOI/2023-24, dt.23.12.2023 estimating amount of Rs.3,35,000/-; (iii) construction of 900 mm CC drain from Tirumalasetti Sridhar house to Y.Venkateswara house road in Ward NO.26 under agreement No.35/20224, dt.14.07.2023 for an amount of Rs.4,33,852/-; (iv) construction of CC drain from Lakkapragada Satyanarayana house to D.No.24-396, Panta

Kaluva in Ward No.5 under agreement No.132/2023-24, dt.02.02.2023 for an amount of Rs,409,387/-; (v) construction of CC road and CC drain from D.No.12-415 to D.No.12-445 in Stadium road, Ward No.28 under agreement No.286/JTO-I/2023-24, DT.29.11.2023 for an amount of Rs.3,33,618/- and (vi) construction of 450 mm CC drain from Bhogeswara Rao house to Gandikota Satyanarayana house in employee colony, ward No.05, under agreement No.68/2023-24, dt.31.10.2023 for an amount of Rs.5,83,199/-.

The learned counsel further submits that the petitioner duly executed the work to the satisfaction of the 3^rd respondent. It is further submitted that after execution of the works, the petitioner has submitted respective final bills aggregating to a sum of Rs.44,40,295/- and the authorities of the 3^rd respondents approved the bills, but so far no payment has been made to the petitioner.

The learned standing counsel for the 3^rd respondent, on oral instructions, submits that the works undertaken by the petitioner was completed to the satisfaction of the 3^rd respondent. However, on account of lack of funds, the payment could not be made to the petitioner.

Considering the submissions that the work completed by the petitioner is not in dispute and on account of the lack of funds, the payment for the work undertaken by the petitioner could not be released, there shall be a direction to respondents 2 and 3 to verify and release the payments due payable to the petitioner within a period of eight weeks.
