The present Writ Petition is filed questioning the action of the Respondents in not paying the differential amount of final leave encashment amounting to Rs.3,22,598/- to the Petitioner as illegal and arbitrary.

The Petitioner had joined the Registration Department in the year 1982, and later he was allotted to the State of Andhra Pradesh and had retired from service on attaining the age of superannuation in April 2020 in the category of Assistant Secretary to Government (GAD), A.P. Secretariat, Velagapaudi, Guntur. It is stated that G.O.Ms.Nos. 1 and 2 dated 17.01.2022 were issued by the State Government revising the pay scales of Government Employees with effect from 01.07.2018, and G.O.Ms.No.110, Finance Department, dated 25.05.2022, was issued for implementing the monetary benefits in view of the revision of pay scales with effect from 01.04.2020.

It is further stated that G.O.Rt.No.587, General Administration (Estt.I) Department, dated 01.05.2020, was issued

sanctioning 300 days of earned leave in lieu of encashment at the time of retirement. As the Petitioner had retired from service on 30.04.2020, the Petitioner claims Earned Leave Encashment for the differential period of 300 days with effect from 01.04.2020.

Though the claims of the Petitioner were considered and uploaded in the CFMS Portal vide Nos. 2023-527992 and 2023527029 for Rs.50,974/- and Rs.271,624/- respectively, totaling Rs.322,598/-, the amount was not paid to the Petitioner till date. Hence, the present Writ Petition.

Sri S. Raju, Assistant Government Pleader, passed on the Written Instructions, wherein it is stated that the amounts claimed by the Petitioner are not disputed. However, it is stated that the bills raised in the CFMS portal were returned to the D.D.O., and the Department did not re-upload in the CFMS portal for payment. It is further stated that as and when the bills are received from the General Administration Departments, the amounts due to the Petitioner would be cleared on priority by the Respondents.

As there is no dispute to the entitlement of the amount due

to the Petitioner i.e., an amount of Rs.3,22,598/- towards Earned Leave Encashment, the present Writ Petition is disposed of with the following directions:

i) The Respondent Authorities are directed to process and release the amounts due to the Petitioner within a period of three months from the date of receipt of a copy of this Order.
