No. 10038/2021 and Batch) dated 05.10.2021 under Flood Damage Repairs (FDR)-11/2015 Grant to the petitioner till today even after execution of the work and causing heavy loss even though the work were completed within time as illegal, arbitrary and violative of Article 14, 16 and 21 of the Constitution of India and consequentially direct the Respondents to release and pay the total bills amount of Rs.95,901/(Rupees Ninety five thousand nine hundred and one only) with Interest under Flood Damage Repairs (FDR)-11/2015 Grant forthwith to the petitioner

This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:

Heard learned counsel for the petitioner and learned Assistant Government Pleader for Irrigation.

Today, when the matter came up for hearing, the learned Assistant Government Pleader furnished a copy of instructions received from the Executive Engineer & DPD, Irrigation Department vide letter No.EE/ID/Atmakur/Court case/camp-I, dated 18.09.2025, wherein it is admitted that the petitioner had completed the work in November 2015, and the bill was sent to APAO works and projects, Nellore in March 2017 for arranging payment. However, the bill was returned due to lack of funds.

As the amount of Rs.95,901/- is an admitted amount payable to the petitioner, this Court feels it appropriate to dispose of the writ petition by

directing the respondents to make the said payments as expeditiously as possible, preferable within a period of four (04) weeks from the date of receipt of a copy of this order.

As far as interest component is concerned, if there is any subsisting clause in the agreement/work order envisaging payment of interest upon any amount which is due and payable, the same is binding upon both the parties.
