Heard Sri D.Kishore Kumar, learned counsel for the petitioners, Smt. Sudeepthi Potiuri, learned Assistant Government Pleader for Mines and Geology appearing for respondent Nos.1 to 3, Sri Burlu Chandra Sekhar, learned counsel representing Sri Yelisetti Somaraju, learned Standing Counsel for Andhra Pradesh Pollution Control Board appearing for respondent No.4, learned Assistant Government Pleader for Revenue appearing for respondent No.5 and Sri Harish Kumar Rasineni, learned counsel for unofficial respondent No.6.

The grievance of the petitioners is that the respondents have not considered the representation of the petitioners dated^18.08.2025. 3. It is contended that the land in Survey Nos.44/3, 44/4A, 44/4B2, 374/2 and 42/3B situated at Komaragunta Village, Vedurukuppam Mandal, Chittoor District, belongs to the petitioners herein. However, the Mining Department has granted a quarry lease for colour granite in favour of the 6*^ respondent over an extent of 4.936 hectares in Survey No. 480 of Komaragunta Village, Vedurukuppam Mandal, Chittoor District, which is adjacent to the subject lands of the petitioners.

It is further contended that the said quarry is causing significant pollution, which is also affecting the agricultural fields, and also shows its

impact on the agricultural yield. In view of the same, the petitioners have made a complaint through the ‘SPANDANA’ platform, but^{thesamehasnot} been considered by the authorities so far.

Today, when the matter is taken up for hearing, learned Assistant Government Pleader for Mines and Geology would submit that pursuant to the representation of the petitioners, the respondents^{haveactedupon} it and the Office of the District Mines and Geology Officer, Chittoor along with Tahsildar, Vedurukuppam Mandal Surveyor, Vedurukuppam and Station^{HouseOfficer,} Vedurukuppam inspected the subject area on 12.08.2025^{inthepresenceof} the petitioners and representative of the quarry lease.^{TheDistrictMinesand} Geology Officer, Chittoor vide letter dated 23.08.2025^{addressedaletterto} the Tahsildar, Vedurukuppam to furnish the following^details;

“/. Category, classification, ownership of the land^{inSy. No.44/3,} 44/4A, 44/4B2, 374/2, 47/3B along with their actual extents allocated In procession on field along with extent of encroachment depicting on the map. a. Category, classification, ownership of the land^inSy.No.39, 40, 42, 43. Their actual extents.

Hi. Is there any gap area between the guarry lease^grantedarea of Sy.No.480 and the land in Sy.No.39, 40, 43 & 44. iv. Furnish the extent of area occupied in Sy.No.480^i.e.,guarry lease granted area as noticed during the course of^joint inspection. ”

5 % 6. Having regard to the same, Smt. Sudeepthi Potiuri,^{learnedAssistant} . Government Pleader for Mines and Geology submits that^{thereisnoinaction} on the part of the respondents in considering the representation of the petitioners.

On the other hand, the learned Standing Counsel for the Andhra Pradesh Pollution Control Board (APPCB) submits that^{the6'^respondenthas} obtained necessary permissions of Consent to Operate^(CTO)from the APPCB vide proceedings in No.CTR-193/APPCB/ZO-TPT/CTO/2025/^dated 31.07.2025 for the purpose of mining Colour Granite. 8. Having regard to the contentions made by both the learned^counsel,this Court deems it appropriate to dispose of the writ petition^{byobservingthat} there is no inaction on the part of the respondents in considering the representation dated 18.08.2025 of the petitioners,^ascontended. 9. Accordingly, the Writ Petition is disposed of with a direction to the respondents to pass appropriate orders upon conclusion^{oftheproceedings} initiated pursuant to the representation of the petitioners,^{asexpeditiouslyas} possible. There shall be no order as to costs.
