Challenging the action of the respondents in cancelling G.O.Ms.No.484, Revenue (ENDTS.III) Department dated 29.11.2019 vide G.O.Ms.No.508 Revenue (ENDTS.III) Department dated 27.12.2019, basing * on the proceedings of the 2"“ respondent vide Board Resolution No.95, dated 23.10.2019, and consequent letter of TTD, EO vide ROC No.83/15340/2010 dated 03.12.2019 cancelling the petitioner’s appointment as Assistant Public Relations Officer (APRO) in TTD, the instant writ petition has been filed.

It is contended that the petitioner was appointed as an Officer on Special Duty (OSD) in Public Relations Department, Tirumala Tirupathi Devasthanams (TTD) on consolidated pay of Rs.30,000/vide proceedings in ROC NO.PR2/325/PRO/2016 dated 13.04.2016. The said services were extended from time to time up to 20.05.2020. The 2^^ respondent vide proceedings in ROC.NoB3/15340/2010 dated 13.06.2018 has considered the petitioners candidature for regularization of services to the post of APRO i n TTD.

It is further contended that the 1 respondent vide G.O.Ms.No.484 dated 29.11.2019, has regularized the services of the petitioner. However, the same was cancelled vide proceedings G O.Ms.No.508 dated 27.12.2019 on account of the fact that the services of

with vide Board resolution No.95 dated the petitioner were dispensed 23.10.2020. Hence, the present Writ Petition. nd is the 5. The 2 respondent filed counter affidavit stating that it discretion of the management to terminate one’s services,^{asitisthechoiceof} either to utilize the services of the petitioner or^otherwise. the management depending of the requirement and that the Institution^{wasalsocontemplating} of APRO by direct to recruit suitable qualified candidate to the post recruitment. It is further stated that the petitioner does not have vested^rightto hold a post to the detriment of a suitable candidate,^{whowouldberecruitedby} respondent issued direct recruitment. It is further contended that the of the resolution passed by G.O.Ms.No.484 dated 29.11.2020, being unaware modified through G.O.Ms.No.508 the 2"'* respondent. Therefore the same^was dated 27.12.2019.

It is further stated that while communicating the G.O.Ms.No. 508, dated 27.12.2019 (through which earlier G.0.484, dt.29.11.2019 was has permitted the EO, TTD to fill up the post of cancelled) the government Assistant Public Relations Officer by Direct Recruitment^{andspecifiedthatthe} appointee must have the additional qualification of^{l.T.knowledgeasresolved} No.157 dated 04.10.2010. And it is further stated by the TTD Board resolution that the said post of APRO has to be filled through^{directrecruitmentalone.}

Considered the rival submissions. The order impugned is passed Without affording any opportunity or the without following any procedure.

petitioner was put on notice before his services were dispensed with, during the subsistence of the tenure of the petitioner, without assigning any reasons.

Having regard to the same, the impugned proceedings vide G.O.Ms.No.508 Revenue (ENDTS.III) Department dated 27.12.2019 , and TTD Board Resolution No.95 dated 23.10.2019 are hereby set aside. The matter is remanded to the 2 nd respondent for passing appropriate orders in terms of G.O.Ms.No.484, Revenue (ENDTS. III) Department dated 29.11.2019. However, it is made clear that the petitioner is not entitled to back wages.
