Upgradation of CC Road from D No.25- 11-145 to D No.25-11-132 in chandramouli nagar in division no.27 of NMC Under Gadapa gadapaku mana prabhutvam vide Agreement no.541/GGMP/EEI/202324,Dated.17.01.2024'as bad ,illegal, arbitrary, improper, unjust and against the Article 21 of constitution of india and consequently direct the respondents to pay the amounts of Rs. 19,36,697/- (Nineteen Lakhs, Thirty Six Thousand, Six hundred and Ninety Seven Rupees only) with interest @ 24per annum for the delayed amount till date of realization for the works executed by the petitioner and pass

The Court made the following:

Learned counsel for the petitioner submits that the petitioner has executed works as entrusted by the 3^rd respondent-Corporation and submitted final bills. It is submitted that the competent authority has also recorded the progress of works and certified the works in the M-Book. It is submitted that, in all, an amount of Rs.19,36,697/- is due and payable by the respondents to the petitioner.

Heard the learned counsel for the petitioner, the learned Assistant Government Pleader for Municipal Administration and Urban Development; the learned Assistant Government Pleader for Finance and Planning, and the learned Standing Counsel for the respondent-corporation.

It is stated in the counter-affidavit that the payments due payable to the petitioner are undisputed amounts and seeks time to release the payment to the petitioner.

Considering the submissions, the respondents are hereby directed to verify and release the payments due payable to the petitioner as expeditiously as possible preferably within a period of four (04) weeks from the date of receipt of a copy of this order.
