Since the facts in all the writ petitions are similar and identical, therefore W.P.No.903 of 2022 is taken as lead case,^{andthefactstherein} hereafter will be referred to for convenience.

Brief facts of the case are that, the petitioner is working as Secondary Grade Teacher in MPP School, Kotanka, Garladinee Mandal, Anantapur District. He was suspended from service on 30.01.2021 on the ground that he has intentionally did not give option for transfer to the place where his wife Smt. D. Lakshmi Devi (SA Hindi), ZP High School, Roddam under the spouse factor. While the matter being so, the petitioner was suspended in terms of powers conferred under Sub-Rule (8) of A.P. Civil

Services CCA Rules, 1991 with immediate effect. However,^{hewasreinstated} on 19.03.2021, subject to pending enquiry at the same place. The 4*^ respondent framed the charges on 17.02.2021, on the^{groundthathehas} misutilized the spouse factor and violated the orders issued under G.O.Ms.No.54, dated 12.10.2020. Later, the petitioner has submitted his explanation to the said charges on 27.02.2021, stating^{thathehasexercised} option by availing spouse points in order of preference which^arehigherin house rent allowance. The 4‘^ respondent without assigning any valid reasons issued proceedings vide Rc.No.6077/BI/2021, dated 12.11.2021, imposing major penalty of withholding one (1) increment with immediate effect as per Rule (9) of AP Civil Service (CCA) Rules, 1991. Aggrieved by the orders of the 4*^^ respondent, the petitioner preferred an appeal before the 2^^ respondent and the 2’^^ respondent confirmed the order of the 4^^ respondent without assigning any valid reasons by a common order, dated 17.12.2021 by calling a report from the 4*^ respondent. Hence, the writ petitions are filed.

The pleadings which are cited by the petitioner in^W.P.No.903of 2022, the same are adopted by the other petitioners in ail the remaining writ petitions.

Heard Sri Pamarthy Rathnakar and Ms. Kavitha Gottipati,^learned counsels appearing for the petitioners and the learned^{GovernmentPleader} for Services-lll appearing for the respondents.

On hearing, learned counsel for the petitioners while^reiterating the contents urged in the writ petitions, submits that, the impugned orders

were passed by the authorities without following the procedure contemplated under Rule 20 of ARCS (CC & A) Rules, 1991 and it clearly specifies that the enquiry officer has to conduct detailed enquiry after giving reasonable opportunity to the delinquent officer. After submitting enquiry report, the disciplinary authority has to communicate the said enquiry report along with show cause notice, calling for explanation from the delinquent officer and on after the receipt of said explanation only, the final orders of punishment to be issued against any individual. Therefore, learned counsel for the petitioners requests this Court to pass appropriate orders.

Per Contra, learned Assistant Government Pleader for Services-lll opposed for allowing these writ petitions and prayed to dismiss the same.

On the other hand, learned Government Pleader appearing^for the respondents filed counter affidavits, wherein it^isstatedthat respondents after finding the entire issue as per Rule (9) ARCS (CC&S) Rules, 1991 major penalty of withholding of one (01) increment with cumulative effect was imposed against the petitioners on the ground of Misuse Spouse Points during Teachers Transfers Counseling. It is further stated that aggrieved by the same, the petitioners filed appeals before the appellate authority with a request to review the orders passed by the respondents^andtodropthe punishment awarded to the petitioners and the said appeals are disposed of confirming the orders passed by the respondents. against the said orders the petitioners may fHe revision^{withoutstraightaway} approaching this Court and prayed to dismiss the writ^petitions.

On considering the submissions of both the learned counsels, without touching the merits of the cases, the impugned orders passed by the respondents are set aside. Further, the matters are^{remandedbacktothe} respondents for fresh consideration. Respondents are^{directedtoconsiderthe} matters afresh and pass appropriate reasoned orders^{inaccordancewithlaw} within a period of three (03) months from the date of receipt of copy of this order.
