The Court made the following Orde W.P.No.12998 of 2025 2025 r. (per Hon'ble Sri Justice R. Raghunandan Rao) The petitioner herein is a graduate in Bachelor of Science in Agriculture and had participated in various National Level and State Level Fencing Competitions. He had applied for the post of Field Assistant in East Godavari and Guntur Districts vide Application No.3428222 in response to the notification issued by the 2 nd respondent, calling for applications for this post, The petitioner is also said to have been applied for other posts. However, they are not relevant for the present case.

The petitioner secured 41.50 marks and became eligible to be appointed to the post of Field Assistant, under the M.S.P. category, in Guntur District. The petitioner contends that despite being entitled for such appointment, he was not considered.

counsel appearing for the petitioner would contend that, there were 26 posts of Field Assistant in Guntur District Judiciary out of which five (05) posts could be filled by non-local candidates. Fie would also contend that, one Sri Shaik Shameer, who was higher up in merit in the list and had been appointed as a Field Assistant in Guntur District, had vacated the said post as he had also been selected for the post of Junior Assistant.

Learned counsel for the petitioner would also contend that, upon such vacancy being created, the petitioner was entitled to be appointed to that post even though the petitioner is a non-local.

RRR,J & J5,J'^ 5. The present Writ Petition has W.P.No.l2998of2025 come to be filed, on the ground that, the petitioner, has not been accommodated in the said vacancy despite meeting all the requirements for being appointed to the post of Fieid Assistant in the Guntur District.

Sri Y.N; Vivekananda, learned Standing Counsel, after obtaining instructions, has placed the records, showing the manner in which the posts of Field Assistant had been filled up in Guntur District. The said details reveal the following facts;

(a). A total number of 26 posts had been notified in the cadre of Field Assistant in Guntur District. The first list of the meritorious candidates was published on 29.03.2023. However, only three candidates joined. Thereafter a second list was again published, on 12.07.2023, notifying the 22 vacancies and the names of the candidates who were selected. Out of this, 12 candidates joined leaving a vacancy of 10 posts. A third list was declared, on 30.08.2023 and only 5 candidates joined leaving 5 vacancies, which remained unfilled.

(b). As per the Notification issuedi for Recruitment to these posts, a maximum of 5 posts couid be filled by non-locals. The total number of non-locals who have joined in these posts, in the above three rounds of Notifications, are (1). Ms.Ankitha Marella, (2). Sri Sudhakar Ganapathi and (3). Racharla Nanditha Gupta.

(c). Out of the five vacancies, which ^■P-No.12998RRR,J0/2025& jsj has been are still available one reserved and kept /acancy aside, in relation to the Sports Quota Category. (d). As of now, there atleast two non-locals would be are four vacancies, which can be filled and eligible for appointment under these posts. 7 In view of the aforesaid facts el" rnerit for the the petitioner. who is next in line in order post of Field Assistant under the Sports accommodated i Category, can be RsW Assistant. 8. In these ci - circumstances, this Writ Petition learned 's allowed, directing the Principal District Judge, Guntur, respondent No.3 who is added as suo mofo to appoint the petitioner herein to within the post of Field Assistant a period of SIXsi (06) weeks from provided the the date of receipt of this order and petitioner does not suffer from any disqualifications.
