Heard Sri Narra Srinivasa Rao, learned counsel for the petitioner, Ms Uma Devi, learned panel counsel for respondents 1 and^2and Sri Ajay, learned Assistant Government Pleader for Home for the S'"' respondent. 2. The petitioner made an application vide file No.HYl^077112074924 seeking issuance of passport before the 1®* respondent.^A shortfall notice dated 06.12.Z024 (Ex.P1) was issued to the petitioner.^{Thepetitionerdidnot} submit any explanation.

Learned counsel for the petitioner would contend that^{thepetitionerwas} convicted in S.C.No.22 of 2011 on 28.01.2015, by the learned Sessions Judge, Mahila Court, Vijayawada, Krishna. The Court^{imposedtwoyears} rigorous imprisonment and a fine of Rs.2,000/- for^{theoffenceunderSection} 498(A) IPC, in default to undergo simple imprisonment^{foronemonthand} further imposed simple imprisonment for one year and^{afineofRs.1,000/-} under Section 4 of the Dowry Prohibition Act. The petitioner^{filedCrl.A.No.68} of 2015, and on 30.01.2015 the imprisonment was suspended^andthesame is pending for consideration.

Learned counsel appearing for the respondents would^{submitthatthe} petitioner has to make an application before the concerned Court where the Crl.A.No.68 of 2015 is pending.

In reply, learned counsel for the petitioner would submit that the petitioner will approach the concerned Court and file an application. 6. Given the facts and circumstances, the writ petition is disposed of, with the consent of both the learned counsel, giving liberty to the petitioner to approach the concerned Court and file an applicationⁱⁿ Crl.A.No.68 of 2015. No order as to costs.
