Even where the amended Section 6 of the Hindu Succession Act, 1956 does not apply to a woman claiming as coparcener, she can still have a share by virtue of Section 8 of the Act out of the share notionally allotted to the deceased coparcener whose property is the subject of the partition suit; the share under amended Section 6, where applicable, is merely larger than the Section 8 share. Non-applicability of amended Section 6 therefore does not extinguish the plaintiff's claim.
