This Criminal Petition, under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed by the petitioner/A1, seeking anticipatory bail, in connection with Crime No.339 of 2024 of Prohibition and Excise Station, Ananthapuramu, Ananthapuramu district.

A case has been registered against the petitioner herein

and others for the offence punishable under Section 34(a)(1)(ii) of the AP Excise Act, 1968, (Amendment) Act, 2023.

Case of the prosecution, in brief, is that on 09.12.2024, at about 05.45 PM, on credible information, the Prohibition and Excise Inspector, Ananthapuramu, along with his staff and mediators, proceeded to near Iron Shed, situated at a distance of 200 meters South-West to Rapthadu Railway gate, Near Rapthadu village and Mandal, Ananthapuramu district, and found A3 to A5 in possession of 474 carton boxes each box containing 48 Nips of TI Mansion House French Brandy bottles, total 22,752 bottles. A3 to A5 confessed about the involvement of A1 and A2 in the present crime. A6 and A7 are working as Security Guards to the Iron Shed. After lifting samples, the contraband was seized under cover of a mediators report and a case has been registered against the accused.

A perusal of the material on record, prima facie , goes to

show that the Iron Shed, from where the alleged contraband was seized, was leased out to the petitioner herein by its owners and the petitioner herein/A1 and A2 are alleged to have dumped the

liquor boxes in the said Iron Shed. Learned Assistant Public Prosecutor submits that the investigation is at nascent stage and some more witnesses are to be examined. In view of the aforesaid facts and circumstances of the case, this Court is not inclined to grant bail to the petitioner herein.
