petition under sections 437 & 439 of Cr.P.C(Old Act)/Under Sections 480 & 483 of BNSS, is filed praying that in the circumstances Stated in the grounds filed in support of the Criminal Petition, the High Court may be pleased to enlarge the petitioners/A5 and A6 on Regular Bail in connection with crime No.06/2025 on the file of Chodavaram Police Station, Ankapalli Distr'lct dt.09.01.2025.

The petition coming on for hearing, upon perusing the Petition and the grounds filed in support thereof' and upon hearing the arguments of sri puvvala srinivasa Rao, Ac§vocate for the Petitioners and of Public Prosecutor for Respondent, the C6!ulrt made the following

This Criminal PetitI-On, under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed by the petitioners/A5 and A6, seeking bail in Crime No.06/2025 of Chodavaram police Station, Anakapalle District.

A case has been regI®Stered against the petitioners and others for the offences under sections 20(b)(ii)(6), 25 I/w 8(c) of the NarcotI-C Drugs and PsychotropI'C Substances Act, 1985.

3.I Case of the prosecution, in brief, is that on o9.01.2025, on credible informatl'on regarding illegal possession and transportation of ganja, the S.I of Police, along`with staff and mediators conducted vehicle checking opposite tO Chodavaram police station and found one tractor, without any registration number, coming from AnakapaIIe to Chodavaram side and on seeing the police, the driver of the tractor stopped the tractor and the Persons in the tractor tried to escape. Then police apprehended some Persons and On enquiry, they disclosed theI'r identity particulars and on searcrl, police found 270 kgs of ganja in their possession. The contraband aI,ong with other material was seized under the cover of mediators report and the accused were arrested and remanded to judicial custody on 09.01.2025 and s!'nce then the petitioners are in judicial custody.

Learned Assistant,Public Prosecutor submits that major Part Of the investigation is completed except filing of charge sheet.

A perusal of the material available on record goes to showthat the petitioners were arrested on 09.01.2025 and since then they are languishing in jail i.e. for more than 175 days as on today. The petitioners are daily wage labourer-s.

In view of the aforesaid facts and circumstances Of the Case and since major part of investigation is completed and filing of charge sheet iS only a mere formality, this Court is inclined to grant bail to the petitioners herein, with the following conditions.

(i) The petitioners/A5 and A6 herein shall be released On their executing a personal bond for Rs.10,000/-(Rupees ten thousand only) each with two sureties for the like sum each to the satisfaction of the learned Judicial First class Magistrate-Gum-Principal Junior Civil Judge, Chodavaram;

(ii) on release, the petitioners shall appear before the station House Officer concerned once in a week i.e. on every Sunday between 10.00 a.m. and 05.00 p.m., till filing of charge sheet;
