This Criminal Petition, under Sections 480 and 483 of the

Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed by the petitioner/A3, seeking regular bail, in Crime No.550 of 2024 of PM Palem Police Station, Visakhapatnam Commissionerate.

A case has been registered against the petitioner herein and others for the offence punishable under Section 20(b)(ii) read with 8(c) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short ‘the NDPS Act’).

Case of the prosecution, in brief, is that, on 20.09.2024, at about 17.30 hours, on credible information, the Woman SubInspector of Police, PM Palem Police Station, along with her staff and mediators, conducted raid near YSR Cricket Stadium, PM Palem, Visakhapatnam city, and found A1 to A3 in possession and illegal transportation of 3.5 Kgs of Hashish Oil/Weed Oil on a Scooty bearing registration No.AP 39 KT 7877. A1 to A3 confessed that they got the said Hashish Oil from one Sanker. The contraband along with vehicle and other material was seized under cover of a mediators report and a case has been registered against the accused.

A perusal of the material on record goes to show that the contraband allegedly seized from the possession of the accused is 3.5 Kgs of Hashish Oil/Weed Oil, which is a commercial quantity. It is submitted by the learned Assistant Public

Prosecutor that the investigation is not yet completed and other accused are to be apprehended. In view of the aforesaid facts and circumstances of the case, this Court is not inclined to grant bail to the petitioner/A3.
