The Court made the following:

1. The Criminal Petiti o n, under section 482 of the Bharati y a Nagarik Suraksha Sanhita, 2023 (for short, ‘BNSS’) is filed on be h alf of the petitioner/accused to grant anticipatory bail in connection with Crime No.228 of 2021 of V. Satram Polic e Station, SPSR Nellore District.

2. A case has been re g istered against the petitioner herein an d others for the offence punishable und e r Sections 427 of IPC and 21(4) of MMDR Act.

3. The prosecution's c ase, in brief, is that the de facto c omplainant submitted a complaint to t h e police on 21.06.2021, stating that t h e accused persons (A.1 to A.3) were g ranted permission and a license to tran s port gravel

from Survepalli Reservoir, V. Satram Mandal. However, it is alleged that A.1 to A.3 extracted gravel from the reservoir and transported an excess of 10,629 metric tons without obtaining the necessary permission from the concerned authorities. Based on this complaint, the police registered a case against the accused persons as outlined in the above-mentioned crime.

4. The learned counsel for the petitioner submits that the petitioner is apprehensive of being arrested in connection with the above crime i.e., Cr.No.228 of 2021 of V.Satram Police Station. In light of the same, the petitioner has approached this Court by filing the present Criminal Petition, seeking the relief of anticipatory bail.

The learned Assistant Public Prosecutor, representing the Respondent/State, submits that in response that, according to the material on record, the petitioner has not been named or shown as an accused in the proceedings. Therefore, there is no immediate threat or likelihood of arrest, and as such, the petition for anticipatory relief is unwarranted.

6. Having carefully considered the submissions of the both learned counsel, and duly noting the submissions made by the learned Assistant Public Prosecutor, this Court views that there are no sufficient grounds to continue with the proceedings in this matter.

7. Consequently, the Criminal Petition is disposed of , with no further relief or orders being granted at this stage.

Miscellaneous applications pending, if any, in this Criminal Petition, shall stand closed.
